Ban the Box/Fair Chance Hiring Rules
Currently, New Jersey employers with 15 or more employees, regardless of where the employees actually reside, are prohibited from inquiring about an applicant’s Criminal History, including conducting internet searches, until after an initial interview has taken place.
Credit History Bans
Currently, New Jersey has no statewide Credit History Ban.
Medical or Recreational Marijuana Laws
Currently, New Jersey allows the use and possession of marijuana by individuals for medical purposes by qualifying patients. The law expressly protects users of lawful Medical Marijuana off-premises and during non-working hours from discrimination. Employers are prohibited from taking any adverse employment action against a current or prospective employee based on that person’s status as a state-registered, qualifying user of medical marijuana. Adults age 21 and older in New Jersey may possess and use up to 6 ounces of Marijuana. The law also includes the cultivation, processing, and sale of marijuana.
Salary History Bans
Currently, New Jersey employers are prohibited from screening job applicants based on their Salary History including, but not limited to, prior wages, salaries, or benefits and from requiring that the applicant’s salary history satisfy any minimum or maximum criteria.
