Company to Pay Nearly $1.2 Million in Civil Penalties for Employment Eligibility Verification Form Violations

Immacuclean Cleaning Services in New York was the subject of an investigation by the Department of Homeland Security, Immigration and Customs Enforcement over the past year.  During that time, the company was required to produce Forms I-9 for hundreds of employees.  The investigation yielded the following findings:

  • failure to prepare or present I-9s for 224 employees,
  • failure to timely prepare I-9s for 102 employees, and
  • failure to ensure proper completion of section 1 and/or failure to properly complete section 2 of the I-9s for 337 employees.

The Administrative Law Judge found the company liable for 655 total violations of the Immigration and Nationality Act. The penalty was also enhanced for findings of bad faith and violations involving unauthorized workers, resulting in $1,161,143.20 in total penalties.
