In February, Hire Image posted that the U.S. Citizenship and Immigration Services (USCIS) released the new Form 1-9, Employment Eligibility Verification. However, the USCIS allowed the older form (dated 07/17/2017) to be used through April 30, 2020, so that employers could make the necessary updates to their processes. As of May 1st, the new form, with a date of 10/21/2019 (found in the lower left corner of the document), must be used.
Last month, amid COVID-19 concerns, the Department of Homeland Security (DHS) issued a statement allowing for discretion to defer the physical presences requirement of the Form I-9. While this discretion remains, the remainder of the information must be completed on the new form.
Employers should ensure they are utilizing the correct form by May 1st. Please contact us if you have any questions.
