The Equal Employment Opportunity Commission (“EEOC”), the Federal Trade Commission (“FTC”), the U.S. Department of Justice (“DOJ”), and the Consumer Financial Protection Bureau (“CFPB”) have expressed concerns in the past about how automated systems and artificial intelligence (AI) used for employment decision-making can result in discriminatory outcomes. Now, these agencies have taken action by coming together to release a joint statement pledging to increase “enforcement efforts to protect the public from bias in automated systems and artificial intelligence.” The statement outlines their recent accomplishments in this area and stresses that despite the benefits associated with automated systems and AI, they have “the potential to perpetuate unlawful bias, automate unlawful discrimination, and produce other harmful outcomes.”
