As we start the new year, many employers anticipate welcoming new team members. If you find yourself in the midst of processing applications and conducting job interviews, it’s advisable to consider the pay equity changes that have been implemented or are scheduled to take effect in the coming months.
States who have proposed or implemented salary transparency laws include:
U.S. Congress also introduced their Salary Transparency Act which would require employers to disclose wages to the public or internal postings of employment opportunities. These updates do not cover all state laws enacted in 2023.
Employers are advised to verify the applicable state and local laws for their workforce, including remote employees, and to carefully examine the specific details of these laws.
Additionally, it is prudent for employers to assess whether they are subject to state or local regulations prohibiting the inquiry into an applicant’s wage history. With the exception of Rhode Island, there were limited new developments in wage history legislation in 2023.
