Attention Employers: New I-9 Form and Remote Procedures Required

I-9 & E-Verify

Employers in the United States are now required to use the latest version of Form I-9 (edition date of 08/01/23) for new hires, as of November 1, 2023. A revised Spanish-language Form I-9 is also available for use in Puerto Rico. The updated Form I-9 and a shortened eight-page set of instructions can be found on the USCIS website. Additionally, USCIS has released an updated Handbook for Employers, a helpful resource for those managing Form I-9-related matters.

Further, employers who are in good standing with E-Verify may continue to remotely examine employees’ Form I-9 documents, benefiting those employers with remote workers or those who adopted remote I-9 document verification during the pandemic. Employers choosing to offer this alternative procedure to new employees at an E-Verify hiring site must do so consistently for all new employees at that site. However, employers can also opt to use this alternative procedure for remote hires only, while maintaining in-person examination procedures for employees who work onsite or in a hybrid capacity.
