Kentucky Legalizes Medical Marijuana

Effective January 1, 2025: Kentuckians who are “qualified patients” will be able to apply for a medical marijuana card after obtaining a written certification from their doctor showing a qualified medical condition. “Qualified patient” means a person who has obtained a written certification from a medicinal cannabis practitioner with whom he or she has a bona fide practitioner-patient relationship. The law specifically allows patients with cancer, chronic pain, multiple sclerosis, epilepsy, nausea, and post-traumatic stress disorder to obtain a doctor’s recommendation to use cannabis medicinally. While the law does not allow patients to smoke marijuana, it allows for the sale of unprocessed cannabis flower, marijuana edibles, and topical products.
