Effective August 27, 2021: Prior convictions of misdemeanors and certain felonies in Arizona will be set aside, allowing the person to seek a “Certificate of Second Chance.” With some protection in mind for employers, the new law limits the liability of an employer who hires a person with past convictions. Under the law, the employer will not be held liable for alleged negligent hiring or damages and injuries that are caused by employees with “Certificates of Second Chances.”
Once again, the rights of the people with criminal convictions must be balanced with the employers who hire them due to recidivism concerns.
