New York City Employers Required to Provide Salary Range in Employment Ads

Effective May 15, 2022, New York City employers with four or more employees must provide the minimum and maximum salaries for any advertised job, promotion, or transfer opportunity. According to the new rule, which amends the NY State Wage Theft Prevention Act (WTPA), “in stating the minimum and maximum salary for a position, the range may extend from the lowest to the highest salary the employer in good faith believes at the time of the posting it would pay for the advertised job, promotion or transfer opportunity.” The statute specially exempts temporary employment at a temporary help firm, such as staffing firms, from this requirement.

The WTPA, which went into effect in 2011 (and has undergone a number of revisions over the years), requires employers to, among other things, provide to employees “new hire” notices and paystubs containing specific and enumerated information.
