Effective July 1, 2020: Virginia employers are prohibited from requiring job applicants to disclose any information related to an arrest, criminal charge, or conviction for simple marijuana possession. The new Virginia law also goes a step further in providing a statutory right to applicants not to disclose such information to a prospective employer. Additionally, under the law, such information maintained in the Virginia Central Criminal Records Exchange will not be open for public inspection, subject to certain statutory exceptions.
It should be noted that the law does not apply to distribution of or intent to distribute marijuana.
