Virginia’s Stance on Salary History Bans

A growing number of states have implemented statutes or policies commonly known as “salary history bans” or equivalent measures. Numerous states, such as California, Colorado, Illinois, New York, and Washington, enforce the requirement for employers to include salary ranges in job postings.

Conversely, in Connecticut, Maryland, Nevada, and Rhode Island, employers must disclose salary ranges either by default or upon request during the interview stage, rather than in the job postings themselves. Alabama, Delaware, Hawaii, and Minnesota prohibit employers from requesting applicants’ salary history altogether.

However, on March 14, 2024, Virginia Governor vetoed two identical bills passed by the Virginia legislature which aimed to prevent employers from inquiring about a job applicant’s salary history and mandated the inclusion of pay information in job listings.

Governor Youngkin recognized the significance of tackling wage discrepancies; however, he criticized the legislation, stating it amounted to governmental intrusion. He argued that it provided insufficient information during the hiring phase, neglected the requirements of businesses, and posed the risk of subjecting small enterprises to legal action.

Describing it as a “one-size-fits-all approach,” he contended that it failed to acknowledge the diverse landscape of Virginia businesses. He further emphasized concerns about its potential negative impacts on small businesses, prospective employees, and the overall economy.
