Currently, Colorado employers are prohibited from advertising that a person with a criminal history may not apply for a position; Placing a statement in an employment application that a person with a criminal history may not apply for a position; or inquiring about an applicant’s Criminal History on an initial application.

Currently, Colorado has a Credit Ban prohibiting employers from using consumer credit Information for employment purposes unless the information is substantially related to the employee’s current or potential job.

Currently, Colorado authorizes the possession and use of Medical Marijuana for certain patients with debilitating medical conditions. Employers are specifically not required to permit or accommodate the use, consumption, possession, transfer, display, transportation, sale, or growing of marijuana in the workplace. Persons age 21 and older may legally possess, use, display, purchase, or transport Marijuana for recreational use.

Currently, Colorado employers are prohibited from (1) seeking the wage history of a prospective employee; (2) relying on the Wage History of a prospective employee to determine a wage rate; or (3) discriminating or retaliating against a prospective employee for failing to disclose wage history.
