Currently, Maryland employers with 15 or more full- time employees may not “require an applicant to disclose whether the applicant has a Criminal Record or criminal accusations brought against them” before the first in person interview.

Currently, Maryland employers are prohibited from using an applicant’s or employee’s credit report or Credit History in determining whether to (1) deny employment to the applicant; (2) discharge the employee; or (3) determine compensation or the terms, conditions, or privileges of employment.

Currently, Maryland allows the use and possession of Marijuana by individuals for medical purposes by qualifying patients. Employers are specifically not required to permit or accommodate the use, consumption, possession, transfer, display, transportation, sale, or growing of marijuana in the workplace.

Currently, Maryland employers may not seek Pay History, but may confirm wage history voluntarily provided by an applicant after an initial offer of employment. Employers must provide an applicant the wage range of the position for which the applicant applied, if requested.
