Currently, New York has no statewide Ban the Box or Fair Chance Hiring Rules. However, New York City, Buffalo, and Rochester all have their own “ban the box” rules. Additionally, New York State’s Correction Law, Article 23A, must be complied with when using criminal history information during the hiring process.
- Credit History Bans
Currently, New York has no statewide Credit History ban. However, New York City has its own ban. Employers are prohibited from using an individual’s consumer Credit History in making employment decisions. It is an unlawful discriminatory practice for an employer, labor organization, employment agency or licensing agency to request or use information from the credit history of an applicant or employee with regard to hiring, termination, promotion, demotion, discipline and compensation.
- Medical or Recreational Marijuana Laws
Currently, New York allows the use and possession of Marijuana by individuals for medical purposes by qualifying patients. The law specifically provides a non- discrimination requirement and states certified patients are deemed to have a “disability” under New York’s Human Rights Law. Possession and Recreational use of up to three ounces of marijuana or 24 grams of concentrated cannabis, such as oils derived from a cannabis plant, by adults 21 and over is now legal in New York. Adults can consume marijuana anywhere it is legal to smoke tobacco and can also store up to five pounds at home.
- Salary History Bans
Currently, New York employers are prohibited from inquiring into or relying upon the Salary History of an applicant or employee in determining whether to offer a job and in setting that person’s salary. Employers are also prohibited from retaliating against applicants or employees who refuse to disclose salary history information.
