Currently, Texas has no statewide Ban the Box or Fair Chance Hiring Rules. However, the city of Austin has its own rule: Austin’s Fair Chance Ordinance prohibits private employers with fifteen or more employees from inquiring about an applicant’s criminal history until after making a conditional offer of employment. This rule affects employers with at least fifteen employees who work primarily within the City for each working day in twenty or more calendar weeks in the current or preceding calendar year.
