Currently, Washington employers are prohibited from asking about arrests or convictions before an applicant is determined otherwise qualified for the position under the state’s new Fair Chance Act.
- Credit History Bans
Currently, Washington prohibits a person from procuring a Consumer Report for employment purposes where any information in the report bears on the consumer’s credit worthiness, credit standing, or credit capacity.
- Medical or Recreational Marijuana Laws
Currently, Washington allows the use and possession of marijuana by individuals for medical purposes by qualifying patients who have a recommendation from a doctor to use Medical Marijuana. Employers may establish drug-free work place policies and are specifically not required to permit or accommodate the use of marijuana in the workplace. Persons 21 of years or older may possess, use, share, and purchase marijuana for recreational use at home or on private property. Marijuana may not be grown by individuals at home (although the state is considering the option), nor may it be used in public places.
- Salary History Bans
Currently, Washington employers with 15 or more employees are prohibited from asking applicants or their current or former employers about their prior wages or salaries. Employers are also prohibited from requiring an applicant’s prior wage or Salary History meet certain criteria. Employers can confirm an applicant’s prior salary if the applicant voluntarily discloses the information or after the employer has made an offer of employment, with compensation.
